The Residential Real Estate Process in New Jersey: A Step-by-Step Guide

Every New Jersey residential closing follows the same nine stops, whether it’s a starter home or a multimillion-dollar estate. I’ve personally walked hundreds of buyers and sellers through this exact process — here’s what actually happens between a signed contract and getting the keys.

1. Hire a Real Estate Professional

A knowledgeable real estate agent will help navigate the market, identify properties, and negotiate favorable terms. Both buyers and sellers benefit from professional representation. Without a knowledgeable real estate professional, you increase the odds of finding yourself in a tricky situation.

2. Get Pre-Approved for a Mortgage (For Buyers)

Before starting the home search, buyers should get pre-approved for a mortgage to determine their budget and demonstrate financial readiness to sellers. This step helps alleviate concerns a seller may have, and might help elevate your offer over others in a competitive real estate market.

3. Find a Property and Make an Offer

Once a buyer selects a home, their real estate agent submits a written offer. The seller can accept, reject, or counter the offer. Negotiations may involve price, contingencies, and closing terms. Having a sound understanding of what you are agreeing to is crucial in ensuring a smooth real estate transaction.

4. Attorney Review Period

New Jersey residential real estate transactions require an attorney review period, typically lasting anywhere between one and five business days. During this time, both the buyer’s and seller’s attorneys review and modify the contract as needed. Either party may cancel the contract without penalty during this period. After attorney review, the buyer conducts a home inspection to uncover potential issues. The scope of the home inspection will be negotiated during contract signing and during the attorney review period, if needed. If significant defects are found during the home inspection, an experienced real estate attorney will negotiate repairs or price adjustments (credits), and if the parties can not reach resolution, the deal may be terminated.

6. Apply for a Mortgage (For Buyers)

Once attorney review is completed, the buyer finalizes their mortgage application. The lender will order an appraisal to confirm the home’s value. Working with an experienced lender is also paramount as the lender will be able to ensure contract deadlines are followed and the closing is not delayed.

7. Title Search and Insurance

Your New Jersey real estate attorney will work with a title company to ensure the property has clear title, free from legal issues. Buyers purchase title insurance to protect against any future claims, and as such, is one of, if not the most important aspect of buying a house. If there are any issues found on title, your real estate attorney will work with the title company to remedy such issues prior to closing.

8. Final Walkthrough

Before closing, the buyer does a final walkthrough to ensure the property is in the agreed-upon condition.

9. Closing

At closing, both parties sign final documents, funds are transferred, and the buyer receives the keys. The deed is recorded with the county, officially transferring ownership. Many closings are now handled virtually, without the seller appearing in person.
